CREATING AZ PURCHASE CONTRACT AND FANNIE MAE PURCHASE ADDENDUM:
The seller's name is Fannie Mae
The offer MUST contain Buyer's legal/correct name. No amendments will be allowed. Line 27: Check off the AS-IS Addendum, and AZ HOA addendum if applicable. Line 28: DO NOT check off the On-site Waste Water Addendum. Seller will not sign the AZ On-Site Waste-Water Addendum. Seller will pay for the inspection report but not the transfer fee. In the event, necessary repairs are required; buyer will have the opportunity to negotiate repairs with the seller. If no pre-negotiated repairs costs were agreed upon it can become an offset from any seller's concessions balance if an amount had been previously negotiated in the purchase agreement. The Seller's title company has been disclosed in the MLS under "Submit Offer With/Seller's Title Company". If your Buyer would like to utilize the same title it needs to be specified in both the purchase agreement and FM purchase addendum (page 13 under buyer's and seller's attorney). Pursuant to section 28 of real estate addendum, this contract is subject to all terms and conditions set forth in the real estate purchase addendum. Add following verbiage under Section 38. Additional Terms & Conditions in the FM Purchase Addendum. Change amount(s) accordingly if the Buyer is requesting repair costs and/or closing costs to be paid by seller:
Seller will perform repairs prior to closing not to exceed $0.00 in accordance with Section 6 of the Real Estate Purchase Addendum. Seller will contribute up to $0.00 towards buyer closing costs, points, and prepaids. In the event that the buyer's lender restricts the allowable Seller contributions toward Buyer's closing costs, Seller's actual and total contribution shall be limited to the allowable amount. Notwithstanding, the language in section 8o of the state sales contract, nothing in this agreement shall constitute a release or waiver by Seller of any claim or right that it may have with respect to any third parties, including but not limited to the Brokers in this transaction. Seller will not provide a home warranty in addition to any seller's concessions. However, seller's concessions may include a home warranty.
